STAGE Academy Pty Ltd & the Trustee of the STAGE Holdings Trust (ABN 30 241 679 044), together with its organisational representative, STAGE Holdings Pty Ltd (together STAGE Academy) may offer tickets to virtual events they hold such as the STAGE Virtual Masterclass.
Virtual events are not physical events and are instead held in an online space accessed through a link or URL.
General Terms and Conditions
Please read these Terms and Conditions carefully before purchasing a ticket. You should not purchase a ticket unless you are 18 years of age or older and understand and agree to these Terms and Conditions. If you have any questions, please let us know.
By purchasing a ticket from STAGE Academy (including through any third-party ticketing platform), you agree to be bound by these Terms and Conditions. Where a third-party ticketing platform is used, purchases are also subject to the Terms and Conditions of such ticketing website. STAGE Academy has no responsibility nor does STAGE Academy make or give any warranty or representation regarding the platform or activities of any third-party ticketing service. You should always check the security of such a platform before entering any financial or personal information.
These Terms and Conditions relate to both the sale of tickets and attendance at STAGE Academy virtual events and apply to both the original purchaser and any subsequent ticketholders (you).
STAGE Academy may vary these Terms and Conditions at any time by updating them. Any variations will only apply to ticket purchases made after the Terms and Conditions have been updated.
STAGE Academy reserves the right to re-schedule any virtual event. STAGE Academy will provide you with a ticket for the re-scheduled date of the event or provide a refund inclusive of any booking fee (subject to any third-party ticketing platform’s Terms and Conditions). A refund should be requested within the time frame set out in our Refund terms below and must be made in writing. If you do not seek a refund in this period, STAGE Academy may decline to provide you with a refund (in its absolute discretion).
If an event is cancelled STAGE Academy will offer you a full refund inclusive of any booking fee (subject to any third-party ticketing platform’s Terms and Conditions) unless cancellation is due to circumstances beyond the reasonable control of STAGE Academy, in which case we reserve the right to retain a reasonable portion of the fees you have paid to cover our unavoidable costs.
STAGE Academy reserves the right to vary the content of any advertised program, prices, ticket categories, audience capacity and hosting platform for virtual events but will always ensure that the event is of a high standard.
Details about how to access the virtual event will be delivered via the email address provided during purchase, this email is your ticket to the virtual event.
Accessing a STAGE Academy virtual event is reliant upon you having a device capable of accessing and loading the online platform used to deliver the event. If you are unable to access the event due to an issue relating to:
a. your internet connection;
b. your device; or
c. your software systems
you will not be entitled to any refund or remedy against STAGE Academy. If you have any concerns as to the system requirements needed to access our virtual events, please make an enquiry prior to buying a ticket.
When purchasing tickets for an event you may be limited to a specific number of tickets. If our platform allows you to exceed the stated ticket limit due to a technical error, you may have any or all of your orders and tickets cancelled (and refunded less any unavoidable ticketing fees charged to us by a third party provider) without notice by STAGE Academy at its discretion. This includes orders associated with the same name, e-mail address, billing address, credit card number or other information. Ticket limits apply to ensure fair access to tickets.
You are responsible for the tickets purchased and no liability or refund may be obtained for tickets lost, stolen or forgotten.
STAGE Virtual Masterclass sessions are recorded and unless otherwise stated will be available for ticketholders for a period of up to 12 months following the date of the event including for ticketholders who did not attend the virtual event at the time it was held.
Copyright in the material used and disseminated in the conduct of an event by STAGE Academy is and remains the property of STAGE Academy and all rights are reserved in accordance with the provisions of the Copyright Act 1968 (Cth) (each a Copyright Work). The Copyright Works made available to you in connection with any event are for your personal use only. You may not copy, distribute, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any content, materials or products provided to you by STAGE Academy unless expressly authorised by law. You agree to not offer, or make available to third parties, products made available to you by STAGE Academy, or developed, adapted, modified from or created using or by reference to our Copyright Works, whether or not you do so for financial reward.
Additionally, you agree that you will not create, attempt to create, or assist others to create or attempt to create, a product that competes with our service offerings by reference to our Copyright Works.
STAGE Academy events, including but not limited to STAGE Virtual Masterclass, may include confronting content. No psychological assessment is conducted prior to attendance and no aftercare is provided for any emotional damage suffered following our events.
Before you attend one of our events you, you should seek medical or psychological advice from a suitably qualified person as to the appropriateness of STAGE Virtual Masterclass for you. You acknowledge that attendance may be triggering for some participants and agree to seek the support of a mental health care professional if you are affected by the content provided. To the extent permitted by law, STAGE Academy do not accept any liability of any kind, whether in contract, tort or otherwise, for any act, omission or default through negligence or other means, of third parties over whom STAGE Academy have no direct control. Under circumstances where liability cannot be excluded, the liability is limited to the value of the purchased ticket. No claim in contract, tort or otherwise can be made by you for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond the reasonable control of STAGE Academy.
To the extent permitted by law, you agree that in no circumstance will STAGE Academy be liable to you for indirect loss, loss of profits, loss of opportunity or loss of enjoyment.
The term “including” when used in these Terms and Conditions is not a term of limitation.
The laws of South Australia apply.
Conditions of Virtual Entry
Details about how to access the virtual event will be delivered via the email address provided during purchase, this email is your ticket to the virtual event and will be required to gain entry. Tickets are non-transferable unless otherwise agreed by STAGE Academy and only one person is permitted at attend the Virtual Masterclass per Ticket purchased.
STAGE Virtual Masterclass uses virtual break-out rooms and carefully timed break-out activities, as such each participant is required to access their ticket and join the virtual event on a separate device (i.e. you cannot have multiple people join the virtual event on one device even if you have paid for a ticket for each person). For the avoidance of doubt, each ticket to a STAGE Academy virtual event only permits a single person to view the content provided by STAGE Academy. You may not allow any third party access to the virtual event, or share resources with them without our prior written consent.
Admission to a virtual event is subject to the following terms:
You may be denied entry into, or removed from, a virtual event where STAGE Academy has reasonable grounds to do so, including if you:
• breach these Terms and Conditions;
• breach our Program Guidelines avaliable [here];
• are intoxicated or under the influence of illicit drugs,
• behave in a harassing, threatening, abusive, disruptive or inappropriate manner; or
• behave in a way that adversely affects the enjoyment of the event by others or their ability to access the event.
If you are denied entry or removed from a virtual event you will not be eligible for a refund and will not have access to recordings of the virtual event.
If you attempt to join the virtual event late you may not be admitted until a suitable break in the event.
You are not permitted to use cameras, screen recorders, screen shots, or other recording equipment (including mobile phones) or software, unless otherwise advised.
By attending the virtual event, you agree that you may be filmed and/or recorded, and you give permission to STAGE Academy to use your image, likeness and voice obtained at the event to promote or explain our services to the public. If you provide any written comments or feedback on STAGE Academy to us, you grant us a perpetual, irrevocable, royalty-free, world-wide, assignable and sub-licenceable licence to use that content for any purpose.
During your participation in STAGE Academy’s events, you may disclose information about yourself, or learn of information about other participants. When this happens, you agree that:
• It is a condition of participation in our events that you keep that information confidential and do not share it outside of the STAGE Academy event; and
• Despite this being a condition of participation, STAGE Academy cannot guarantee that your information will be kept confidential, and to the extent permitted by law you release us from any liability arising from another participant disclosing information about you to a third party.
Refunds
STAGE Academy offers refunds or exchanges for change of mind or change in personal circumstances where such a request is made at least 7 days prior to the event.
Unless otherwise stated, STAGE Academy does not offer refunds or exchanges as a result of a change in your personal circumstances less than 7 days prior to the event or due to external factors such as, for example illness, injury or bereavement.
If you have purchased the STAGE Bundle Deal (comprising the STAGE Academy online course and the STAGE Virtual Masterclass) the refund policy set out in our General Terms & Conditions apply to both your STAGE Academy Virtual Masterclass as if it were the STAGE Academy Online course in place of this refund policy.
STAGE Virtual Masterclass sessions are recorded and unless otherwise stated will be available for ticketholders to access for a period of up to 2 months following the date of the event including for ticketholders who did not attend the virtual event, or any part of the virtual event, at the time it was held. Access to these recordings constitutes attendance at the virtual event and as such no refund or exchange will be available to ticketholders who are unable to attend any of the sessions at the time they are held.
STAGE Academy will only offer a refund if an event is cancelled or rescheduled (and you cannot or do not wish to attend the rescheduled event), or to the extent otherwise required by law. If an event is rescheduled you must apply for a refund in writing by the earlier of:
(a) 4 weeks after notification of the reschedule or relocation; or
(b) 7 days prior to the event.
If you do not request a refund by that date, you will be deemed to have agreed to having your ticket transferred to the rescheduled event and will not be entitled to claim a refund.
If an event is cancelled or rescheduled by STAGE Academy, all liability is limited to the amount for which the ticket was purchased (including any fee or charges unless otherwise notified at the time of purchase). Proof of purchase may be required for any refund. Unless required by law, STAGE Academy will not be liable for any other losses incurred by you as a result of the cancellation or rescheduling of an event.
Tickets may not, without the prior written consent of STAGE Academy (and any authorised third-party ticketing platform) be resold or offered for resale at a premium or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the ticketholder may be refused admission.
Note: the resale of tickets in certain circumstances is considered ticket scalping that is governed by ticket sales legislation and may attract criminal penalties.
